1. Scope
1.1 These General Terms and Conditions (terms) apply to all contracts that consumers conclude with Glen Dimplex Benelux B.V. ("we") via our online shop at shopdimplex.de.
1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 of the German Civil Code, BGB). Our offer is aimed exclusively at consumers.
1.3 We do not accept the customer's own terms unless we expressly agree to them.
2. Contracting party and language of the contract
2.1 Your contracting party is Glen Dimplex Benelux B.V., Saturnus 8, 8448 CC Heerenveen, the Netherlands, registered with the Kamer van Koophandel under number 16084292. Further details are in our legal notice (Impressum).
2.2 The language of the contract is German.
3. Conclusion of the contract
3.1 The presentation of products in the online shop is not a legally binding offer but an invitation to place an order.
3.2 You can add products to the basket and order via the checkout. Before submitting your order, you can check your details at any time and correct them using your browser's back function or the editing options in the checkout. By clicking the order button, you make a binding offer to buy the goods in your basket.
3.3 Immediately after submitting your order, you will receive an order confirmation by email. With receipt of this order confirmation, we accept your offer and the purchase contract is concluded.
4. Storage of the contract text
We store the contract text. We send you the order details and these terms with the order confirmation by email. You can also view and save these terms on this page at any time. If you have created a customer account, you can view your orders there.
5. Prices and shipping costs
5.1 All prices are final prices in euros including statutory VAT.
5.2 Delivery within Germany is free for all items. Details are in our shipping and delivery terms.
6. Payment
6.1 The available payment methods are listed on our "Payment methods" page and in the checkout.
6.2 The purchase price is due when the contract is concluded. If you pay with Klarna, Klarna's terms also apply, in particular regarding payment terms and instalments.
7. Delivery
7.1 We deliver only to delivery addresses in Germany. Shipping is with DHL.
7.2 Processing and delivery times are in our shipping and delivery terms and on each product page.
7.3 If an ordered product is unexpectedly unavailable, we will inform you without delay. We will refund any payments already made without delay.
7.4 Partial deliveries are possible where reasonable for you. They do not create any additional shipping costs for you.
8. Retention of title
The goods remain our property until paid for in full.
9. Right of withdrawal and voluntary right of return
9.1 Consumers have a statutory right of withdrawal. Details are in our cancellation policy.
9.2 In addition, we grant a voluntary right of return of 30 days from receipt of the goods. The conditions are on the same page. The statutory right of withdrawal is not affected.
10. Statutory warranty
The statutory rights for defects apply. The limitation period for claims for defects is two years from delivery of the goods.
11. Guarantee
In addition to the statutory rights for defects, we grant a guarantee on products bought in our online shop in accordance with our guarantee terms. Your statutory rights are not restricted by the guarantee.
12. Liability
12.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee given.
12.2 In the event of a slightly negligent breach of an essential contractual obligation, our liability is limited to the foreseeable damage typical for this type of contract. Essential contractual obligations are obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely.
12.3 Otherwise, liability for slight negligence is excluded.
13. Transport damage
If goods are delivered with obvious transport damage, please report this to the delivery driver as soon as possible and let us know. Your statutory rights are not affected; your report helps us make claims against the carrier.
14. Customer service and dispute resolution
14.1 You can reach our customer service by email at support@glendimplex.com.
14.2 We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
15. Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.
16. Final provisions
If individual provisions of these terms are invalid, the validity of the remaining provisions is not affected.
